When a person becomes incapable of indicating intent

A person who meets the following characteristics prior to age 18 is considered to be incapable of indicating intent:

Has an I.Q. of 49 or less.

Has a mental age of seven or less.

Is determined incompetent by a court or is found incapable of indicating intent by a psychologist, physician, or developemental disabilities professional.

before the age of 18, the state of residence is the state in which the parent or guardian resides at the time of request for MA-LTC or at the time the child enters the facility.
